Loss of Enjoyment of Life - Flagler Beach - The Church Member and The Paddle Boarder

In the State of Florida including Flagler Beach and the surrounding areas, an injury victim can seek compensation in the form of economic damages and non-economic damages. Economic damages refers to set and determinable damages in the form of past and future medical expenses, past and future wage loss, and past and future loss of earning capacity. Non-economic damages refer to damages in the form of pain, suffering, mental anguish, and the loss of enjoyment of life. For purposes of this article, the focus will be on the loss of enjoyment of life.

The damages in the form of loss of enjoyment of life are very unique to the individual claiming damages. The loss of enjoyment of life can be something as simple of the inability to sit through a church service without discomfort. While the act of sitting through a church service is not the most physical of activities, it does count as part of the loss of enjoyment of life damages.

Another example would be the damages to an avid paddle boarder who can no longer do this activity. Alternatively, it can also be the paddle board who can no longer engage in this activity without pain. The damages can be more involved if the paddle boarder engaged in the activity on a frequent basis. The paddle boarder does not need to be a competitive athlete or even that good at paddle boarding. If there was a certain enjoyment gained from the activity, then it can be presented as a component of the damages for the injury victim.

In most cases, the focus of the damages will be geared towards the medical records, procedures, and bills. It is also geared towards the pain and suffering caused by the serious injuries related to the automobile accident or other incident causing the damages. Certainly, the loss of enjoyment of life component of the damages adds as bit of of a personal touch to the victim and the case.

In every case that is put into litigation, the defense / insurance company attorney always ask the injury victim the following two questions:

Is there anything that you are not able to do any longer due to the accident related injuries?

Is there anything that you still do but is more difficult due to the accident related injuries?

The above questions if properly and accurately answered do touch upon the loss of enjoyment of life component of damages. As such, the injury victim and family should consider the response to above questions when discussing the affects of the injuries upon the injury victim's daily life.
